Does the Windfall Elimination Provision still reduce your Social Security benefits? No. The Social Security Fairness Act, signed into law on January 5, 2025, repealed both the Windfall Elimination Provision, commonly called WEP, and the Government Pension Offset, known as GPO.
WEP previously reduced certain retirement or disability benefits for people receiving pensions from employment that was not covered by Social Security. GPO could reduce or eliminate Social Security spousal and survivor benefits.
These reductions no longer apply to benefits payable for January 2024 and later. However, other Social Security rules, including reductions for claiming before full retirement age and the retirement earnings test, may still affect your benefit.
Avoid relying on older Social Security calculators that still apply WEP or GPO. Use an updated calculator and review your official Social Security record before estimating your retirement income. Learn more through the official Social Security Fairness Act guidance from the SSA.
