How Long Does the Guardianship or Conservatorship Process Take?

How long does it take to obtain guardianship or conservatorship for an incapacitated spouse?

The process often takes several weeks to a few months, but the exact timeline depends on state law, the local court’s schedule, required medical evidence, background checks, investigations, and whether anyone challenges the petition.

During this waiting period, household bills, insurance premiums, medications, and care expenses will continue. Starting the legal process early can help prevent missed payments and financial emergencies.
