Is my husband’s debt now mine after his death? The answer depends on how the debt was held and the laws in your state.
If the debt was jointly held or you co-signed for it, you are generally still responsible for repayment. However, debt held only in your husband’s name is usually paid from his estate rather than by you personally.
The rules can differ in community property states. Before paying anything or accepting responsibility, confirm what you legally owe with a qualified estate attorney.
